Notice of Public Auction – Jackson Grove Park Tennis Courts

To Whom It May Concern:

Please be advised that pursuant to the laws of the State of Michigan and the City Charter for the City of Negaunee, the City of Negaunee hereby gives notice of its intent to sell at a public auction on May 18, 2020, at 10:00 a.m. in the City of Negaunee City Hall via teleconference (instructions below Parcel # 52-53-280-042-00, commonly known as Jackson Grove Park Tennis Courts property (the “Property”) and more particularly descried as:

The East 287 feet of lot 40, measured at a right angle to the East line of said Lot of Lot 40 of the Assessor’s Plat of Jackson MISC. (51-T47N-R27W).

The minimum opening bid for the Property shall be $ 1.00. The Property will be sold to the highest bidder “AS IS” by Quit Claim Deed with no guarantees for any further construction and/or improvements to the Property. The Property shall also be sold subject to any existing easements and further subject to any future easements needed for roads or utilities.

Additionally, the successful bidder must agree that the property will remain open to the public and will be used and properly maintained as tennis courts, only. If this condition is not satisfied at any time, the property will immediately revert to the City. Further, the successful bidder must, and agrees to, resurface the tennis courts within one (1) year of the date of transfer, and to maintain the courts and grounds. If this condition is not satisfied at any time, the property will immediately revert to the City.

The successful bidder shall be responsible for all costs, fees and expenses associated with the purchase.

The successful bidder at said auction will be required, at the conclusion of the auction, to make a down payment equal to 10% of the final sale price. Final payment, plus a deed recording fee of $30.00 will be due no later than seven (7) days after the date of said auction (May 25, 2020). The successful bidder shall also be required to sign, under penalties of perjury, a statement that neither they nor any other person, who would gain equity in the property, have any tax delinquencies or are otherwise in default to the City of Negaunee. Upon receipt of the full payment, the City Treasurer shall execute, deliver, and cause to be recorded on behalf of the City of Negaunee the Quit Claim Deed necessary to transfer the title of the Property.

All Bidders must register via teleconference. Registration will begin at 9:00 a.m. and close promptly at 9:45 a.m.
